The new lawsuit comes from a report published in November. The user found that under the iOS 14.6 system, "detailed usage data was sent to Apple" from App Store, Apple Music, Apple TV and Books. Researchers say stocks send less identifiable information than other applications. It is reported that the data sent is related to an identifier that can identify the user. It is reported thatthis behavior still exists in iOS 16, butresearchers cannot check what data is sent because these data are encrypted. The researcher did tell Gizmodo that under any combination of privacy settings, neither health nor wallet sent similar data. All data is sent to a server different from the iCloud array.

The plaintiff stated that, "Apple's practices violate the privacy of consumers; deliberately cheat consumers; enable Apple and its employees to have the right to know intimate details about their personal lives, interests and application use; and make Apple a potential target of 'one-stop shopping' for any government, private or criminal actor who wants to undermine personal privacy, security or freedom. Through its universal and illegal data tracking and collection business, Apple even knows the most private and potentially embarrassing aspects of user application use -- whether users accept Apple's illusory proposal to maintain the privacy of these activities".

Apple has also made it clear that its advertising platform will not connect user or device data with data collected from third parties for targeted advertising. They also said that they would not share user devices or device identification with data collection companies, whether it was the App Store or the iPhone itself. However, according to the evidence provided by the plaintiff, it was proved that Apple was deceiving its users, andwas suspected of violating the privacy area protected by the Fourth Amendment, and violated the criminal laws of dozens of states on eavesdropping and privacy violations, and the Fourth Amendment does not seem to apply here.

The plaintiff hopes that the lawsuit will seek "compensation and all other forms of fair monetary relief", as well as injunctive relief that the court may deem appropriate. A jury trial is required. It is unclear when or whether the case will be heard.
